As from 31st December, 2012, article 755 CGI has
instituted a new rule in relation to undisclosed bank accounts and
life insurance policies held abroad by French residents. Until
then, the prescription period of either three, six or ten years
applied to effectively frank past less than full disclosures and
non-compliant "forgetfulness".
The drafting is exceptionally slick in that it reduces the
issues to treating the asset as subject to wealth, gift and
succession duty taxation, where its provenance has not been
declared or remains unjustified following a new investigative
procedure set down at L. 23C of the Livre des procedures fiscales,
introduced at the same time. That procedure is in addition to the
existing procedures at articles 1649A and 1649AA of the CGI, which
introduced a deemed income tax liability to sums paid out of
accounts and Life policies which are not disclosed by foreign
Banks and Life Insurance Companies. They precede the Trustee
declaration requirements at article 1649AB.
The change in effect brings Life Insurance policies into a
similar form of declarative treatment as trusts which are
dealt with in the following article 1649AB.
In short, unless evidence is produced rebutting the
presumption, the prescription period is down, and any receipt or
gift that can be attributed to the account or policy, or within it
will be taxed at 60%, the maximum rate of gratuitous transfer
duty.
In short, it is becoming increasingly difficult for French
residents and those moving to France to be able to use foreign
accounts and Life insurance policies, freely, both within and
without the EU. The incidence of this and whether it remains within
the fiscal exception to on the EU freedom of movement of
capital in relation to third states is likely to be reviewed at
some stage by the CJEU, as will the expropriative rate of 60% by
the ECHR. Whether such a review will be in favour
of the taxpayer is another matter. However there are ways
through this maze.

Les avoirs figurant sur un compte ou un contrat
d'assurance-vie étranger et dont l'origine et les modalités
d'acquisition n'ont pas été justifiées dans le cadre de la
procédure prévue à l'article L. 23 C du livre des procédures
fiscales sont réputés constituer, jusqu'à preuve contraire, un
patrimoine acquis à titre gratuit assujetti, à la date d'expiration
des délais prévus au même article L. 23 C, aux droits de mutation à
titre gratuit au taux le plus élevé mentionné au tableau III de
l'article 777 du présent code.
Ces droits sont calculés sur la valeur la plus élevée connue de
l'administration des avoirs figurant sur le compte ou le contrat
d'assurance-vie au cours des dix années précédant l'envoi de la
demande d'informations ou de justifications prévue à l'article L.
23 C du livre des procédures fiscales, diminuée de la valeur des
avoirs dont l'origine et les modalités d'acquisition ont été
justifiées.
NOTA:
Loi n° 2012-1510 du 29 décembre 2012 de finances
rectificative pour 2012 : Ces dispositions s'appliquent aux
demandes adressées par l'administration à compter du 1er janvier
2013.
L. 23 C reads as follows and refers to the declaration
requirement by foreign Banks and Life insurance policies at article
1649AA, and will inevitably be backed up by an information exchange
request to the organisation concerned.
Lorsque l'obligation prévue au deuxième alinéa de
l'article 1649 A ou à l'article 1649 AA
du code général des impôts n'a pas été respectée au moins
une fois au titre des dix années précédentes, l'administration peut
demander, indépendamment d'une procédure d'examen de situation
fiscale personnelle, à la personne physique soumise à cette
obligation de fournir dans un délai de soixante jours toutes
informations ou justifications sur l'origine et les modalités
d'acquisition des avoirs figurant sur le compte ou le contrat
d'assurance-vie.
Lorsque la personne a répondu de façon insuffisante aux demandes
d'informations ou de justifications, l'administration lui adresse
une mise en demeure d'avoir à compléter sa réponse dans un délai de
trente jours, en précisant les compléments de réponse qu'elle
souhaite.
In other words a failure to declare a foreign life insurance
policy or bank account on the income tax return at least once
within the preceding ten years will place the French resident
taxpayer at risk of a harsh enquiry backed up by the new
process.
However, the new arrangement only addresses Life Insurance
capitalisation policies whose capital can be accessed and which is
transferable to beneficiaries on the death of the insured.
There are ways and means of using this to advantage in migration
and also on establishment in France, so advice should be taken
prior to taking up short term or permanent residence there.
